1. About these terms

These terms apply when you purchase clothing, merchandise or other products through the Driven By Gabi section of britlithauto.co.uk.

Please read these terms carefully before placing an order. By placing an order, you agree to be bound by them.

Nothing in these terms limits or excludes your statutory rights under UK consumer law.

2. About us

Driven By Gabi is operated by:

trading as Driven By Gabi

All sales made through the Driven By Gabi section of this website are made by Gabija Puidokiene trading as Driven By Gabi.

Payments received from Driven By Gabi sales are received and held by Gabija Puidokiene trading as Driven By Gabi and are used for the operation, development and running of the Driven By Gabi brand and related activities.

Britlith Auto Ltd may provide website hosting, technical support, logistics coordination or administrative services relating to the website, but Britlith Auto Ltd is not the seller of Driven By Gabi merchandise.

In these terms, “we”, “us” and “our” mean Gabija Puidokiene trading as Driven By Gabi.

“You” and “your” mean the person placing an order.

3. Who may place an order

You must be at least 18 years old and legally capable of entering into a contract to place an order.

By placing an order, you confirm that:

  • the information you provide is complete and accurate;
  • you are authorised to use the selected payment method; and
  • you agree to these terms.

Our products are intended primarily for consumers. Please contact us before purchasing products for resale or another commercial purpose.

4. Products and descriptions

We take reasonable care to ensure that product descriptions, photographs, measurements, colours and prices are accurate.

However, product colours may appear slightly different depending on your device, screen settings, lighting and display quality.

Garments and printed products may also vary slightly between manufacturing or printing batches. Minor variations in colour, measurements, print placement or finish will not normally mean that a product is faulty.

All garment measurements are approximate. Please check the relevant size guide before placing your order.

Unless expressly stated otherwise, vehicles, accessories, props and other items appearing in product photographs are not included with the product.

5. Limited-run, preorder and made-to-order products

Some Driven By Gabi products may be produced in limited quantities or printed after an order is received.

Where a product is described as a preorder or made-to-order item, the relevant product page will provide an estimated production or dispatch period.

A standard product printed with one of our normal Driven By Gabi designs is not automatically treated as a personalised product merely because it is printed after you place your order. Your normal cancellation rights will still apply unless a specific legal exception applies.

Products made to your individual specifications may not be returned merely because you have changed your mind.

This may include products displaying:

  • your name;
  • a personalised number;
  • wording selected by you;
  • an image supplied by you;
  • a custom colour or design requested by you; or
  • another genuinely bespoke feature.

This does not affect your rights if a customised product is faulty, damaged, misdescribed or not made in accordance with your agreed instructions.

6. Prices and payment

The price payable is the price displayed on the website when you place your order.

Delivery charges and any other applicable charges will be shown before you confirm and pay for your order.

Product prices will state whether VAT is included where applicable.

We may change our prices at any time. Price changes will not affect orders that we have already accepted.

Payment must be made using one of the payment methods available at checkout.

Payments may be processed by an independent payment provider. We do not normally receive or retain your complete payment-card details.

7. Placing an order

Your order represents an offer to purchase the selected products from us.

After you place an order, we will send an acknowledgement to the email address you supplied.

This acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it.

A binding contract between you and us is formed when we send you:

  • an express order confirmation;
  • confirmation that production has begun for a made-to-order product; or
  • a dispatch confirmation,

whichever occurs first.

Please check your order acknowledgement and confirmation carefully. Contact us promptly if any information is incorrect.

We cannot guarantee that an order can be changed after it has been accepted or entered into production.

8. When we may refuse or cancel an order

We may refuse or cancel an order where:

  • a product is unavailable;
  • payment cannot be authorised;
  • the price or product information contains an obvious error;
  • we suspect fraud, misuse or unauthorised activity;
  • delivery to the requested location is unavailable or restricted;
  • the order breaches these terms;
  • the order includes an unusually large quantity intended for unauthorised resale; or
  • we are unable to fulfil the order for another reasonable operational or legal reason.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

9. Product availability

All products are subject to availability.

Adding an item to your shopping basket does not reserve it.

Occasionally, a product may become unavailable after an order has been placed.

Where this happens, we will contact you and may:

  • offer a suitable alternative;
  • provide an updated estimated availability date; or
  • cancel and refund the unavailable item.

You are not required to accept an alternative product.

10. Delivery areas

We deliver within the United Kingdom and to selected international destinations made available through our checkout.

International delivery availability may vary according to:

  • the destination;
  • courier restrictions;
  • parcel size and weight;
  • product type;
  • customs requirements; and
  • applicable laws.

We cannot accept an order where the checkout does not support the requested delivery destination.

References to international or worldwide delivery on the website are subject to the destinations and services actually available during checkout.

11. Processing and dispatch

Estimated processing, dispatch and delivery periods will be displayed on the website, product page or during checkout.

Unless expressly described as guaranteed, delivery dates are estimates.

Dispatch or delivery may take longer during:

  • preorder periods;
  • made-to-order production;
  • new merchandise launches;
  • unusually busy periods;
  • public holidays;
  • severe weather;
  • courier disruption;
  • supply-chain disruption; or
  • circumstances outside our reasonable control.

Where the law requires delivery within 30 days and no different delivery period has been agreed, we will deliver within that period.

Where an alternative delivery period has been clearly agreed with you, that agreed period will apply.

If we fail to deliver within the required or agreed period, you may have the right to cancel the order and receive a refund.

12. Delivery charges

Delivery charges are calculated according to factors including:

  • delivery destination;
  • parcel size;
  • parcel weight; and
  • selected delivery service.

The applicable delivery charge will be displayed before you complete your order.

Where you cancel the whole order under your statutory cancellation rights, we will refund the cost of our least expensive standard delivery method.

Any additional amount paid for express, premium, timed or enhanced delivery will not normally be refunded.

13. International taxes and customs charges

Orders delivered outside the United Kingdom may be subject to:

  • import VAT;
  • customs duties;
  • clearance fees;
  • handling fees; or
  • other local taxes or charges.

Unless the checkout expressly states that these charges are included, you are responsible for paying them.

We do not control international customs charges and cannot predict their amount.

You should contact your local customs authority before ordering if you require further information.

If an international parcel is returned because you:

  • refused delivery;
  • did not pay applicable customs or import charges;
  • did not collect the parcel; or
  • provided an incomplete or incorrect address,

we may deduct reasonable delivery, return and administrative costs from your refund where legally permitted.

14. Delivery and responsibility for the products

Delivery is completed when the products are delivered to:

  • the delivery address supplied with your order;
  • a person identified or authorised by you;
  • a neighbour authorised by you;
  • a safe place authorised by you; or
  • a collection point or parcel locker selected by you.

Responsibility for the products passes to you when delivery is completed.

Ownership of the products passes to you once we have received full payment.

You are responsible for ensuring that the delivery address supplied is complete and accurate.

Please contact us immediately if you notice an address error. We cannot guarantee that an address can be changed after the order has been processed or dispatched.

15. Delayed, missing or damaged parcels

Before contacting us about a missing delivery, please check:

  • the courier’s tracking information;
  • any safe places around the property;
  • whether a neighbour accepted the parcel;
  • any delivery card or electronic notification; and
  • the relevant collection point or parcel locker.

If a parcel appears to have been lost, damaged in transit or incorrectly delivered, contact us as soon as reasonably possible.

Please provide:

  • your name;
  • your order number;
  • the delivery address;
  • a description of the issue; and
  • photographs of the parcel, packaging or product where appropriate.

Prompt reporting helps us investigate the issue with the courier, but you will not automatically lose your statutory rights because you did not report the issue within a particular number of days.

16. Your right to cancel an online order

For most products purchased online, you have the legal right to cancel your order without giving a reason.

The cancellation period ends 14 days after the day on which:

  • you receive the product;
  • a person nominated by you receives the product; or
  • you receive the final product where one order is delivered separately on different days.

To exercise your right to cancel, you must clearly inform us of your decision before the cancellation period expires.

You may also cancel by post using the trading or correspondence address shown in Section 2.

Please include your:

  • name;
  • address;
  • order number;
  • details of the products being cancelled; and
  • clear statement that you wish to cancel the contract.

You do not have to use the model cancellation form at the end of these terms, but you may do so.

17. Returning a cancelled order

After informing us that you wish to cancel, you must return the products within 14 days.

Unless the product is faulty, damaged, incorrect or misdescribed, you are responsible for the direct cost of returning it.

Products must be returned to the returns address displayed in Section 2 or otherwise provided to you when your return is authorised.

Please include the following information inside the parcel:

  • your name;
  • your order number;
  • your email address; and
  • details of the products being returned.

We recommend using a tracked or signed-for delivery service and retaining proof of postage.

You are responsible for the return until it reaches the specified returns address.

Please ensure that the correct postage is paid. Where legally permitted, reasonable unpaid postage or return charges may be deducted from a refund.

18. Condition of change-of-mind returns

You may inspect a product in the same way that you would reasonably be permitted to inspect it in a physical shop.

You may be responsible for a reduction in the product’s value if you handle it beyond what is necessary to establish its nature, characteristics and fit.

Change-of-mind returns should therefore be:

  • unworn, except for a reasonable fitting;
  • unwashed;
  • free from marks, stains and damage;
  • free from strong odours, smoke and excessive fragrance;
  • free from pet hair;
  • returned with labels attached where reasonably possible; and
  • returned with original packaging where reasonably possible.

Removing packaging or a label does not automatically remove your cancellation rights.

However, we may make a lawful deduction from your refund where unnecessary or excessive handling has reduced the value of the product.

19. Products that cannot normally be returned for a change of mind

The statutory right to cancel may not apply to:

  • products made to your individual specifications;
  • clearly personalised products;
  • sealed products that are unsuitable for return for health or hygiene reasons once unsealed, where the legal exception applies;
  • products that become inseparably mixed with other items after delivery; or
  • other products legally excluded from cancellation rights.

This section does not affect your rights where a product is:

  • faulty;
  • damaged;
  • incorrectly supplied;
  • misdescribed; or
  • not made according to agreed instructions.

20. Refunds following cancellation

Where you validly cancel an order, we will refund:

  • the price paid for the returned products; and
  • the cost of our least expensive standard delivery option where the whole order is cancelled.

We may withhold the refund until:

  • we receive the returned products; or
  • you provide evidence that you have sent the products back,

whichever occurs first.

Refunds will be made without undue delay and normally within 14 days of the relevant event described above.

Refunds will normally be made using the original payment method unless otherwise agreed.

Payment providers and banks may take additional time to display the refunded amount in your account.

We may make a lawful deduction where excessive handling has reduced the value of the returned product.

21. Exchanges

We may offer exchanges, including size exchanges, subject to product availability.

However, we are not legally required to provide an exchange where you have simply changed your mind.

Where an exchange is unavailable, you may return the original product for a refund and place a new order.

An exchange arrangement does not reduce or replace your statutory cancellation or consumer rights.

22. Faulty, damaged, incorrect or misdescribed products

Products supplied to consumers must be:

  • of satisfactory quality;
  • fit for their normal purpose;
  • fit for any specific purpose agreed with you; and
  • as described.

Contact us at gabia@britlith.co.uk if you believe a product does not meet these requirements.

Please provide:

  • your name;
  • your order number;
  • a description of the issue; and
  • photographs where appropriate.

Depending on the circumstances and your legal rights, we may offer:

  • a refund;
  • a repair;
  • a replacement; or
  • an appropriate price reduction.

Where a product is faulty, damaged, incorrectly supplied or misdescribed, we will cover reasonable return costs or provide an appropriate return method.

Your legal rights may include:

  • a short-term right to reject qualifying faulty goods within 30 days;
  • a right to request a repair or replacement; and
  • in appropriate circumstances, a right to a price reduction or final rejection.

Normal wear and tear is not normally considered a fault.

We will not normally be responsible for damage caused by:

  • misuse;
  • accidental damage after delivery;
  • improper washing or drying;
  • failure to follow care instructions;
  • unauthorised alteration; or
  • unreasonable treatment of the product.

Nothing in these terms restricts your rights under the Consumer Rights Act 2015.

23. Sale and promotional items

Your statutory rights apply to sale, reduced-price and promotional products.

A reduction in price does not remove your rights where a product is faulty.

However, you may not be entitled to complain about a particular fault where that fault was clearly brought to your attention before you purchased the product.

24. Care instructions

You must follow the washing, drying, ironing and other care instructions supplied with the product or displayed on the product page.

Printed garments may require you to:

  • wash them inside out;
  • use a low-temperature wash;
  • avoid harsh bleaching products;
  • avoid tumble drying;
  • avoid dry cleaning; and
  • avoid ironing directly over printed artwork.

The exact care instructions supplied with the product will take priority over these general examples.

We are not responsible for damage caused by failure to follow clearly provided care instructions, misuse or unreasonable treatment.

25. Promotions and discount codes

Promotional and discount codes:

  • must be used before their stated expiry date;
  • may be limited to selected products;
  • may be limited to selected customers or territories;
  • cannot normally be exchanged for cash;
  • may not be used with another promotion unless expressly stated; and
  • may be withdrawn where used fraudulently, unlawfully or contrary to their stated conditions.

If a refund is issued for a product purchased using a discount, the refund will reflect the amount actually paid for that product.

Where a promotion depends on purchasing multiple products, returning part of the order may affect the discount originally applied.

26. Our responsibility to you

We are responsible for foreseeable loss or damage caused by our breach of these terms or our failure to use reasonable care and skill.

Loss or damage is foreseeable where:

  • it was an obvious consequence of our breach; or
  • both you and we knew it might happen when the contract was formed.

We are not responsible for loss or damage that was not foreseeable.

Nothing in these terms excludes or limits liability where doing so would be unlawful.

This includes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory consumer rights; or
  • another liability that cannot legally be excluded.

Products purchased by consumers are supplied for private and domestic use.

We are not responsible for business losses, including loss of:

  • profits;
  • revenue;
  • contracts;
  • business opportunity;
  • anticipated savings; or
  • commercial reputation,

where products were purchased as a consumer for personal use.

27. Events outside our reasonable control

We are not responsible for delays or failures caused by circumstances outside our reasonable control.

These may include:

  • courier disruption;
  • postal disruption;
  • industrial action;
  • extreme weather;
  • flooding;
  • fire;
  • transport failure;
  • interruption to utilities or communications;
  • cyber incidents;
  • supply-chain disruption;
  • government action;
  • import or customs delays; or
  • failure of a supplier or service provider caused by such circumstances.

We will take reasonable steps to minimise the effect on your order and will contact you where the effect is significant.

Your statutory rights concerning delayed or undelivered products are not excluded.

28. Complaints

We aim to resolve complaints fairly and promptly.

We aim to acknowledge complaints promptly and provide a substantive response within 14 days.

Complex matters may take longer to investigate, but we will keep you reasonably informed.

29. Alternative dispute resolution

Alternative dispute resolution is a process through which an independent organisation may consider a consumer dispute without the parties having to go to court.

If we cannot resolve a complaint directly, we will provide information about an appropriate alternative dispute resolution provider where we are legally required to do so.

Unless we expressly agree otherwise, we are not required to participate in a particular alternative dispute resolution procedure.

30. Changes to these terms

We may update these terms to reflect changes to:

  • our products;
  • delivery arrangements;
  • business practices;
  • technology;
  • payment arrangements; or
  • legal obligations.

The terms applying to an order will normally be those published on the website when the order was placed.

Any later change will not normally apply retrospectively to an order we have already accepted.

31. General provisions

If any part of these terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.

A delay in enforcing a right under these terms does not mean that the right has been waived.

Each contract is between you and Gabija Puidokiene trading as Driven By Gabi.

No other person has a right to enforce the contract except where the law expressly provides otherwise.

Britlith Auto Ltd is not a party to the sale contract merely because it provides hosting, technical, administrative or logistical support.

32. Governing law and courts

These terms and any contract formed under them are governed by the laws of England and Wales.

If you live in England or Wales, the courts of England and Wales will normally have jurisdiction.

If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in the courts of the part of the United Kingdom where you live.

If you live outside the United Kingdom, you may also benefit from mandatory consumer protections that apply in your country of residence.
